Peanut-Better-Jam ("the Service") is a paid subscription web application for practicing bass/guitar improvisation. These terms govern your use of the Service and apply in addition to our Privacy Policy.
Subject to an active, paid subscription and your compliance with these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own practice. This license does not extend to anyone else, whether or not they use your account.
You agree not to, and not to help or permit anyone else to:
The Service — including its software, design, text, and audio content — is owned by the site owner (see Legal Notice for identifying details) and protected by copyright and other intellectual property laws. Nothing in these terms transfers any ownership rights to you. All rights not expressly granted are reserved.
Subscriptions are billed in advance on a recurring basis (monthly or yearly, as selected at checkout) via our payment provider. You can cancel at any time through the "Manage subscription" link in the app; cancellation takes effect at the end of the current billing period. No VAT is charged pursuant to § 19 UStG (German small business regulation).
We may suspend or terminate your access to the Service, without refund, if we reasonably believe you have violated these terms — in particular Section 3. We may also discontinue the Service at any time; where reasonably possible, we will give notice in advance.
The Service is provided "as is," without warranties of any kind, to the extent permitted by law. To the extent permitted by law, our liability for damages arising from your use of the Service is limited to cases of intent or gross negligence, except for liability arising from injury to life, body, or health, or under mandatory statutory provisions (e.g. the German Product Liability Act).
We may update these terms from time to time to reflect changes to the Service or for legal reasons. We will post the updated version here with a new "Last updated" date; continued use of the Service after changes take effect constitutes acceptance of the updated terms.
These terms are governed by the laws of Germany. If you are a consumer, mandatory consumer-protection provisions of your country of residence remain unaffected.
